Bivio Terms of Service

These terms are an agreement between you and David Zarinski ("Bivio", "we", "us") covering your use of the Bivio app and website. By creating an account or using Bivio, you agree to them. Please also read our Privacy Policy, which explains what information we collect and how we use it.

We've tried to keep these terms short and readable. The plain-English summary: Bivio is for your family's personal use; your subscription is billed and cancelled through Apple or Google; the stories are ours, but bedtime is yours.

1. Who can use Bivio

You must be an adult (18 or older, or the age of majority where you live) and a parent or legal guardian to create an account. Children use Bivio only together with you, under your supervision, through child profiles you create. You are responsible for all activity on your account.

2. Your account

Keep your login credentials secure and your account information accurate. An account is for one household. You may delete your account at any time in the app's settings; deleting it removes your data as described in the Privacy Policy.

3. Subscriptions, trials, and billing

  • Bivio offers auto-renewing subscriptions purchased through the Apple App Store or Google Play. The price, billing period, and any free-trial terms are shown in the app before you buy.
  • Your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before it renews.
  • Cancel anytime in your App Store or Google Play subscription settings — not by deleting the app or your account, which does not cancel a subscription. After cancelling, you keep access until the end of the paid period.
  • If a free trial is offered, it converts to a paid subscription at the end of the trial unless you cancel before then.
  • Billing, refunds, and payment disputes are handled by Apple or Google under their terms, since they process the payment. We never see your payment details.
  • We may change subscription prices; changes apply only to future billing periods and you will be notified in advance as the app stores require.

4. Your license to use Bivio

We grant you a personal, non-exclusive, non-transferable license to use the app and its stories for your household's private, non-commercial use. All stories, illustrations, characters, and other content in Bivio, and the app itself, belong to us or our licensors and are protected by copyright and other laws.

You may not:

  • copy, record, redistribute, publicly perform, or resell Bivio content outside your household;
  • reverse engineer, modify, or create derivative works of the app, except where the law permits it despite this term;
  • use Bivio content to train machine-learning models;
  • interfere with or circumvent the app's security or subscription features.

5. Acceptable use

Use Bivio only as a reading app for your family, in compliance with applicable law. We may suspend or terminate accounts that violate these terms or abuse the service.

6. Changes to the service

Bivio's story catalogue and features will change over time — we add, update, and occasionally retire stories. We may also update the app, and some updates may be required for continued use.

7. Apple- and Google-specific terms

Your download of the app is additionally governed by the store you got it from: Apple's Licensed Application End User License Agreement (the App Store standard EULA) or the Google Play Terms of Service. If those terms conflict with these, these terms govern the service itself and the store terms govern the download and billing.

For apps downloaded from the Apple App Store, you and we acknowledge:

  • these terms are between you and us, not with Apple, and Apple is not responsible for the app or its content;
  • Apple has no obligation to provide maintenance or support for the app;
  • if the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation;
  • Apple is not responsible for addressing any claims relating to the app, including product-liability, regulatory, or intellectual-property claims;
  • you represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government restricted-parties list;
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

8. Disclaimers

Bivio is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and uninterrupted availability. Bivio's stories are entertainment for families; they are not medical, psychological, educational, or professional advice about your child.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, and our total liability for any claim relating to Bivio is limited to the amount you paid us in the twelve months before the claim arose. Nothing in these terms limits liability that cannot be limited by law, and nothing affects consumer rights you hold under the law where you live.

10. Termination

You may stop using Bivio and delete your account at any time. We may suspend or terminate your access if you materially breach these terms. Sections 4, 8, 9, and 11 survive termination.

11. Governing law

These terms are governed by the laws of Alberta, Canada, and any dispute will be resolved in the courts located there, except where the consumer-protection law of your place of residence gives you the right to a different venue.

12. Changes to these terms

If we materially change these terms, we will post the new version at https://bivioapp.com/terms, update the effective date, and notify you in the app. Continuing to use Bivio after a change takes effect means you accept the updated terms.
